Below are the specific contractual terms that apply to each WebSite Builder – E-Shop Builder solution purchased from Enartia:

This Service Provision Order (SPO) is an integral and essential part of the General Terms of Service as applicable at any given time, which determine the terms of provision of the WebSite Builder – E-Shop Builder Service (hereinafter referred to as the “Service”) by Enartia Monoprosopi S.A. (hereinafter referred to as “Enartia” or “Company”) to the Customer.

Terms beginning with a capital letter and used in this SLA have the same meaning as defined in the General Terms of Service. The commercial offer published electronically on Enartia’s websites (www.enartia.com, https://web.papaki.com) form an integral part of these terms.

Where “Website” is mentioned, it refers to the website of Enartia’s brand “Papaki” https://web.papaki.com.

1 -Description of the Service: WebSite Builder – E-Shop Builder 

The Website Builder – E-Shop Builder Service allows the Customer to create, update, and publish a website through an online management panel without the need to install additional programs.

The Customer uses the Service through a web space assigned to them, accessible via a browser and an internet connection.

The service is offered in various solutions, the features and prices of which are available and regularly updated on the Website.

Enartia reserves the right to carry out promotional activities during the term of the contract, which will be announced and must be accepted in accordance with the terms stated on the Website.

The free trial service (Trial Service), when provided, allows the Customer to create a website on a third-level domain and use the Service free of charge for a limited period of time, as stated on the Enartia Website. Enartia may suspend or terminate the trial service at any time without notice. The terms for the trial period are governed by Enartia’s General Terms of Service.

The Company does not guarantee in any way that the free trial option for the product will always be available.

The WebSite Builder – E-Shop Builder service can be activated on a specific domain purchased by the Customer or on a third-level domain of Enartia.

Enartia does not guarantee the availability or usability of the selected domain name.

Connecting the WebSite Builder – E-Shop Builder service to a domain that already has content will result in the previous content being replaced by the new content of the WebSite Builder – E-Shop Builder, as they are hosted in separate environments. The previous content can be restored by changing the DNS settings.

The Customer acknowledges that they are purchasing a non-exclusive, non-transferable license to use the software, which is valid only for the duration of the subscription.

2 – Terms of Service

DOMAIN NAME:The Website Builder – E-Shop Builder service is activated on Enartia’s third-level domain and can be connected to a second-level domain belonging to the Customer, which is managed by Enartia as Maintainer, Registrar, or Reseller.

STORAGE SPACE: The memory limit is what is stated in the online offer and cannot be exceeded. Additional space can only be purchased through an upgrade. If the memory limit is exceeded, changes to the website will not be published until the upgrade is complete or space is freed up.

TRAFFIC RESTRICTIONS: The Website Builder – E-Shop Builder service includes a monthly bandwidth limit and a maximum number of monthly page views as specified in the corresponding commercial offer. If the Customer exceeds these limits, an upgrade of the package will be required, with corresponding charges. In case of non-upgrade, Enartia is not responsible for website malfunction or service unavailability. If the Customer exceeds the limits, Enartia reserves the right to suspend the service until the Customer returns to the agreed limits or completes the required upgrade. If, after a request from Enartia, the Customer does not comply, Enartia is entitled to terminate the contract for breach and fault of the Customer, without prejudice to the right to compensation.

Furthermore, the Customer must ensure that CPU usage remains in line with the average usage for shared hosting, approximately 0.5% of total capacity, and under no circumstances should maximum CPU usage exceed 3%. In such cases, Enartia reserves the right to suspend the service and, if the Customer fails to comply with a relevant request, Enartia is entitled to terminate the contract, without prejudice to the right to compensation.

PAGE RESTRICTIONS: The Service includes a limit on the number of pages that the Customer’s website may contain. If this limit is exceeded, as defined in the package purchased by the Customer and published online, the Customer cannot add or create additional pages unless they upgrade the service by purchasing a higher-level package.

If the Customer exceeds the features of the most comprehensive package, such as storage space or maximum traffic, they can contact Enartia to receive a personalized offer according to their needs.

DATA STORAGE: The Customer acknowledges and accepts the existence of log files and the use of cookies related to the use of the Service, which are generated and/or maintained by Enartia in accordance with applicable law, for the maximum permissible period. The content of log files is confidential and Enartia only discloses them at the request of the competent authorities and in accordance with the law.

The Customer also agrees that Enartia has the right to store material and disclose it to third parties when required by law or the competent authorities or when necessary for:

  • compliance with legal procedures
  • enforcing the General Terms and Conditions
  • responding to claims for infringement of third-party rights
  • protecting the rights, property, and safety of Enartia, its partners, suppliers, and Customers 

CONTENT RULES: Enartia does not control the content of the Customer’s website, who bears sole responsibility for the content published on their website. The Customer undertakes to comply with all applicable laws and regulations and, in particular, not to publish content of a pornographic or child pornographic nature, defamatory content, content that damages the image of third parties, or content that infringes the intellectual property rights of third parties.

All content provided to the Customer as part of the Service – such as, but not limited to, images, graphics, backgrounds, videos, music, templates, structures, etc. (hereinafter “Content”) – remains the exclusive property of the respective rights holders and/or the Service provider. The Customer acknowledges that they do not acquire any ownership rights to the Content and may only use it:

(i) within the context of the Service,
(ii) online, i.e. within the Enartia platform dedicated to the Service, and
(iii) only for the duration of the Service.

The Customer is obliged to respect the intellectual property rights relating to the Content, as defined by applicable law. In this context, the Customer accepts that any reproduction of the Content in any form is strictly prohibited, unless expressly authorized by the copyright holder.

Upon termination of the license, for any reason, the Customer expressly agrees to immediately cease all use of the Content and destroy any copies in its possession.

ENARTIA’S RESPONSIBILITY: The Service will be available 24 hours a day, seven days a week, except for suspensions required for maintenance work. Enartia is not responsible for service interruptions and undertakes to restore the service as soon as possible in the event of a malfunction. Enartia reserves the right to suspend the provision of the Service at any time for security or confidentiality reasons, informing the Customer accordingly.

Enartia shall in no event be liable for any malfunction or interruption of the Service due to circumstances beyond its reasonable control, including, but not limited to, the following:

  • force majeure events, 
  • events attributable to third parties, such as interruptions or failures in telecommunications services and/or power lines or acts or omissions of the competent Registration Authorities, 
  • malfunctions of terminals or other communication systems used by the Customer. 

REPORTING PROBLEMS: The Customer must report any anomaly or problem with the Service by means of a message with proof of receipt within 48 hours of its occurrence. Failure to comply with the manner and time limits specified exempts Enartia from any liability.

EQUIPMENT: Enartia does not provide any hardware equipment or devices to the Customer.

 

3 – DURAION 

This Service Order, depending on the choice made by the Customer during the purchase process or subsequently through their control panel, may expire (a) with or (b) without automatic renewal

a) Αutomatic Renewal

In the case of automatic renewal and payment by credit or debit card or PayPal, the fees specified in the “Fees and Payments” will be charged by Enartia to the Customer’s credit or debit card or PayPal account in accordance with the terms and conditions in force at the time of renewal, as specified in the control panel, and after prior notification by email. If Enartia is unable to complete the charge, the contract will not be automatically renewed and will automatically expire on the specified date. In this case, the Customer may renew the Service by following the procedure described in section (b).

b) No Αutomatic Renewal

In the event of termination without automatic renewal, the Customer may request Enartia, through the procedure provided by Enartia, to renew the Service for additional periods, within the deadlines indicated in its control panel and in accordance with the technical and financial conditions in force at the time of renewal, by completing the relevant renewal procedure. If the Service is not renewed within the aforementioned time limits and in the specified manner, this Service Provision Order shall automatically expire upon its expiry, without any further notice from Enartia being required.

In any case of termination of the contract as described above, in addition to the deactivation of the features included in the offer, all data & content entered by the Customer and stored on Enartia’s servers will be permanently deleted, without Enartia bearing any responsibility for the preservation and/or creation of backup copies of such data. Therefore, it is the Customer’s sole responsibility to back up the data to an external medium before the expiration date if they do not intend to renew the Service.

4 – Fees and Payments

The fees for providing the requested Service are those specified in the commercial offer.

The provision of the Service is considered agreed upon once the relevant fee is paid by the Customer using the payment method indicated in the commercial Offer.

The renewal price will be the list price applied by Enartia at the time of the Customer’s renewal request, as shown in the control panel.
